    Can you explain to me on why my son don’t qualify for Amendment 821. It’s a level 2 Criminal History category do to a charge that was committed back in 2005 for a drug offense. He got in indicted 2020 for wire fraud. He has a very minimal criminal history. Please explain this “Status Points” thing cause it does make sense and it not fair from him and other individuals that suffer the same fate as him. They deserve relief as well instead of “Status Points Offenders”. He was 22 years old for that old drug charge that was committed, he finished the charge in 2011, he didn’t pled quilty until 2021. Is that too old to count. That’s 10 years for 4a1.1(b). But charged in 2005, that’s 18 years ago. Please help him come home

      According to the guidelines, “a sentence imposed more than fifteen years prior to the defendant’s commencement of the instant offense is not counted unless the defendant’s incarceration extended into this fifteen-year period.”

      Depending on dates, the commencement of the 2020 offense may have begun prior to or after the 15-year time limit expired in this provision. However, since his sentence for the 2005 offense did not end until 2011, it falls within the 15-year time limit set forth in the sentencing guidelines and is thus considered as part of his criminal history.

      Therefore, your son likely doesn’t qualify for the 821 amendments because he was not a zero-point offender and did not receive status points for being on probation or parole when the 2020 offense was committed.
