RESULTS: Client receives 3-year sentence instead of 15–30 years in Sex Crime.

Client was charged in US Federal Court for conduct related to the soliciting and receiving of sexually explicit photos of a minor.

Through early and proactive involvement with Client initially after arrest, board certified federal criminal defense attorney Jacob Blizzard set Client up for a mitigation plan to start making proactive changes in Client’s life to both improve his life and to have mitigation evidence by the time the case came before a federal judge.

Through early negotiation, federal prosecutors agreed to reduce his potential charges from a 15 – 30 year range of punishment to a 0 – 10 year range of punishment.

Client agreed to plead guilty and the federal court would assess punishment in that range.

The government pushed hard to obtain a 10-year sentence, a sentence that was in line with the U.S. Sentencing Guidelines at the contested sentencing hearing.

Mr. Blizzard pushed back, showing all of the Client’s significant work to make real changes for the better since the sex crime criminal offense conduct occurred.

After preparing a motion for downward departure from the sentencing guidelines, presenting a lengthy sentencing memorandum, and arguing the case at sentencing, the Court agreed and granted the downward departure, sentencing Client to only 3 years confinement.
