We are hearing more from folks about the use of AI (Artificial Intelligence) who ask “Can I use ChatGPT for legal advice instead of hiring an attorney?”.
That’s a great question these days, and it’s smart that you’re thinking critically about your sources of legal information.
While ChatGPT can be super helpful for general education or getting a clearer understanding of legal topics, there are a very important reasons why you shouldn’t rely on ChatGPT for legal advice if you’re dealing with an actual or potential legal case:
1. ChatGPT is Not a Lawyer (And never will be)
Even though the AI can explain legal concepts and help clarify confusing terms, it is not a licensed attorney in your state and will never be.
That means:
– It can’t give legal advice tailored to your specific situation.
– It can’t represent you or interpret how the law applies in your jurisdiction.
– It doesn’t know all the facts of your case – and with legal issues, even the small details can drastically change the answer.
2. Laws Change, and ChatGPT Will Not Be Up to Date
ChatGPT training only includes knowledge up until mid-2024. Laws, regulations, or case precedents to change constantly – in every state or local jurisdiction – the AI might give outdated info or even totally wrong information.
3. ChatGPT Can’t Replace a Legal Strategy
If you’re in a real legal situation, you can’t rely on ChatGPT for legal advice. It is terribly risky. You need someone who can:
– Assess evidence in your case
– File legal documents properly
– Argue on your behalf
– Protect your rights
Only a real attorney can build a legal strategy based on those things.
4. Your Information Isn’t Confidential
While ChatGPT doesn’t store personal conversations, you shouldn’t assume the same level of attorney-client confidentiality in ChartGPT as you would with a real lawyer. Anything super sensitive is better kept between you and your attorney.
So When Is It Okay to Use ChatGPT for Legal Stuff?
You can definitely use it to:
– Understand legal terminology
– Learn how the legal system works
– Get a sense of what types of lawyers handle which issues
– Prep smart questions to ask a real attorney
– Summarize complex legal topics in plain English
Once you hire an attorney it is a good tool to help you draft questions to ask your lawyer about your case. So please so not rely on chatGPT for legal advice.
