RESULTS: Termination of Parent Child Relationship
Family Law Attorney Matt Zimmerman goes to trial after his client divorced his spouse after he learned she had sexually assaulted their 2-year-old daughter.
The spouse went to prison, but the father needed to terminate her rights to prevent further trauma to the child.
Course of Action
Matt filed a Petition for Termination with the court.
Matt assisted the client in shopping for an attorney for the Ad-litem and worked with the client in preparing his testimony.
At trial, Matt proved a violation of Texas Family Code Chapter 161 by demonstrating that the Oregon sexual assault statute (where the woman went to prison) was substantially similar to Texas’ sexual assault statute, and additionally that the child was allowed to remain in circumstances detrimental to the child’s physical health and emotional wellbeing.
Termination of Parent Child Relationship – In the Child’s Best Interest
In addition to the violation, Matt convinced the judge, in accordance with the termination statute, that the best interest of the child was served by having the mother’s rights terminated.
