RESULTS: New punishment hearing – prescription fraud – resentencing
Our firm recently secured a new trial for a client involved in a complex case of organized criminal activity. Initially convicted of prescription fraud, the client faced life imprisonment due to habitual offender enhancements.
Legal Challenge
Lawyer Jacob Blizzard identified a pivotal flaw in the prosecution’s case. He argued on appeal that the client’s out-of-state convictions were not sufficiently proven, which impacted the habitual offender enhancements applied to the sentencing.
Court’s Decision
The 11th Court of Appeals in Eastland, TX recognized the validity of our argument, resulting in a reversal of the original sentence.
The case was remanded for a new punishment hearing, opening the door for a more equitable resolution.
Outcome
Upon resentencing, our client received a significantly reduced sentence, reflecting a more just outcome given the circumstances of the case.
This case underscores our commitment to challenging unjust legal outcomes and securing fair trials for our clients. If you or someone you know is facing similar legal challenges, contact our firm for expert legal guidance and representation.
